The order of finish in the Grade 3, $30,000 Higheasterjet Handicap on July 1 at Ruidoso Downs has been restored to the original order of finish by the New Mexico Racing Commission.

JD Baccarat crossed the finish line a head in front of A Toss Up and then was disqualified and placed last for interference by the Ruidoso Downs stewards. The NMRC overruled the stewards’ decision and the NMRC order was signed and finalized on July 27.

The order of finish is JD Baccarat in first-place, A Toss Up in second-place and Noconi in third-place.

The appeal to the NMRC was made by JD Baccarat’s trainer Paul Jones.

A gelding by Mr Jess Perry, JD Baccarat scored his first stakes win in the Higheasterjet. He was third in the $703,000 Ruidoso Derby (G1) in 2011 for owners Johnny Cope, Stan Herzog, Butch Southway, R.D. Hubbard and Bat Masterson.

Within 30 days of this decision, it can be appealed to district court.
